By accessing or using this Website in any way, including browsing, creating an account, or placing an Order, you confirm that:
• You have read, understood, and agree to be bound by these Terms.
• You are at least 18 years of age, or if you are between 13 and 18, you have the permission of a parent or legal guardian who agrees to these Terms on your behalf.
• You have the legal capacity to enter into a binding contract.
• You are not prohibited by any applicable law from using this Website.
These Terms form a legally binding agreement between you and Hackersjack Inc. If you do not agree to these Terms, you must not use this Website.
These Terms should be read together with our Privacy Policy, Returns Policy, and Shipping Policy, all of which are incorporated into these Terms by reference. In the event of any conflict between these Terms and those policies on matters of purchase, the specific policy terms shall take precedence.
3. About Us and Our Products
Captaincyberchamp.com is a merchandise store operated by Hackersjack Inc., the creators of KinderCyber, an educational entertainment brand featuring Capt. CyberChamp and the KinderCyber team. Our Website is primarily designed for parents and adults purchasing merchandise for children.
3.1 Product Descriptions
We make every reasonable effort to ensure that product descriptions, images, and specifications on our Website are accurate and up to date. However, we do not warrant that product descriptions are error-free, complete, or current. If a product you receive is materially different from its description on our Website, your remedy is governed by our Returns Policy.
Product images are for illustrative purposes only. Colours and details may vary slightly due to screen display settings, print calibration, and manufacturing variation. Minor variations of this kind do not constitute a defect.
3.2 Product Availability
All products are offered subject to availability. We reserve the right to limit the quantity of any product available for purchase and to discontinue any product at any time without notice. In the event that a product you have ordered becomes unavailable after your Order has been placed, we will contact you to offer an alternative product, store credit, or a full refund.
3.3 Print-on-Demand Products
The majority of our physical merchandise is produced through a print-on-demand model, meaning items are manufactured specifically in response to individual orders. This affects processing times, return eligibility, and customisation options, as set out in our Shipping Policy and Returns Policy respectively.
4. Account Registration
You may browse and purchase from our Website as a guest. However, creating an account allows you to track orders, save delivery addresses, and manage your purchase history.
4.1 Account Requirements
To create an account you must:
• Be at least 18 years of age.
• Provide accurate, current, and complete information during registration.
• Maintain the accuracy of your account information by updating it as necessary.
• Keep your password confidential and not share it with any third party.
4.2 Account Security
You are responsible for all activity that occurs under your account. If you suspect that your account has been accessed without your authorisation, you must notify us immediately at support@captaincyberchamp.com and change your password. We are not liable for any loss or damage arising from your failure to maintain the confidentiality of your account credentials.
4.3 Account Suspension and Termination
We reserve the right to suspend or terminate your account at any time without notice if we believe you have violated these Terms, engaged in fraudulent activity, or used the Website in a manner that could harm us or other users. If your account is terminated for cause, any outstanding Orders may be cancelled at our discretion. You may close your account at any time by contacting support@captaincyberchamp.com.
5. Placing an Order
5.1 How Orders Are Formed
When you place an Order on our Website, you are making an offer to purchase the selected products at the listed price, subject to these Terms. Your Order is not confirmed until you receive an Order Confirmation email from us. Receipt of an Order Confirmation email constitutes our acceptance of your offer and the formation of a binding Contract between you and us.
We reserve the right to decline any Order for any reason, including but not limited to:
• The product being out of stock or discontinued.
• An error in the listed price or description.
• Suspected fraudulent or unauthorised activity.
• A failure of payment authorisation.
If we are unable to accept your Order, we will notify you by email and provide a full refund of any payment taken.
5.2 Order Accuracy
It is your responsibility to review your Order carefully before confirming payment, including the product selected, size or variant, quantity, and delivery address. We are not responsible for errors in Orders that result from information provided incorrectly by you. Please refer to our Returns Policy and Shipping Policy for your options if you have made an error.
5.3 Order Confirmation
Once your Order is accepted, we will send an Order Confirmation email to the address you provided at checkout. This email will include your order number, a summary of the items ordered, the price paid, and your delivery address. Please retain this email as it constitutes your proof of purchase.
5.4 Order Amendments
Because our orders are processed quickly through our print-on-demand fulfilment network, we may not be able to amend an Order after it has been placed. If you need to make a change, contact us immediately at support@captaincyberchamp.com quoting your order number. We will do our best to accommodate changes before your order enters production, but cannot guarantee this.
6. Pricing and Payment
6.1 Prices
All prices displayed on the Website are in Australian Dollars (AUD) unless otherwise stated. Prices are inclusive of any applicable Goods and Services Tax (GST) where required by Australian law. Prices do not include shipping costs, which are calculated and displayed at checkout before you confirm payment.
We reserve the right to change prices at any time without notice. The price applicable to your Order is the price displayed on the Website at the time your Order is placed and confirmed.
6.2 Pricing Errors
In the event of a pricing error on the Website, we reserve the right to cancel any Orders placed at the incorrect price and issue a full refund. We will notify you as soon as practicable if this situation arises. We are not obliged to honour Orders placed at an incorrect price.
6.3 Payment Methods
We accept the following payment methods:
|
PAYMENT METHOD |
NOTES |
|
Visa and Mastercard |
Processed securely via our payment gateway. We do not store card details. |
|
PayPal |
Payment processed through PayPal. Governed by PayPal's terms. |
|
Apple Pay and Google Pay |
Where available at checkout based on your device and browser. |
|
Afterpay (Buy Now, Pay Later) |
Available on eligible orders. Subject to Afterpay's own terms and approval. |
|
Store Credit |
Applied automatically to eligible orders where a credit balance exists on your account. |
All payments are processed through secure, PCI-DSS compliant payment systems. Your full card details are never stored by us.
6.4 Currency and Conversion
While our prices are displayed in AUD, international customers may be charged in their local currency by their bank or payment provider. Any currency conversion costs or international transaction fees are charged by your bank or payment provider and are not within our control.
6.5 Taxes and Duties
International customers are responsible for any import duties, customs fees, or local taxes applicable in their country of residence. These are not included in our prices or shipping fees. Please refer to our Shipping Policy for further information.
7. Order Cancellation
7.1 Cancellation by You
Because our print-on-demand products enter production shortly after an Order is placed, our ability to cancel an Order is limited. If you wish to cancel, contact us immediately at support@captaincyberchamp.com quoting your order number. We will do our best to cancel before production begins, but cannot guarantee cancellation once an order has entered the fulfilment queue.
If your Order has not entered production, we will cancel it and issue a full refund. If production has already commenced, cancellation may not be possible and the order will be fulfilled in accordance with these Terms.
7.2 Statutory Right of Withdrawal (EU and UK Customers)
If you are located in the European Union or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days of receiving your goods, without giving any reason. Our Returns Policy extends this window to 30 days. This right does not apply to custom-made or personalised goods, including print-on-demand merchandise, in accordance with applicable consumer law.
To exercise your right of withdrawal, notify us at support@captaincyberchamp.com before the withdrawal period expires. We will provide instructions for returning the goods. A refund will be issued within 14 days of receiving the returned goods or proof of return, whichever is earlier.
7.3 Cancellation by Us
We reserve the right to cancel any Order at any time for legitimate business reasons including stock unavailability, pricing errors, suspected fraud, or technical issues. In all cases where we cancel an Order, a full refund will be issued to the original payment method within 5 to 10 business days.
8. Delivery
Delivery of your Order is governed by our Shipping Policy, which is incorporated into these Terms by reference. Key terms include:
• Delivery timeframes are estimates only and are not guaranteed.
• Risk of loss passes to you upon delivery of the goods to the address you provided.
• Title to goods passes to you upon receipt of full payment.
• We are not responsible for delays caused by circumstances outside our reasonable control, including carrier delays, customs processing, and natural events.
• It is your responsibility to provide a correct and complete delivery address. We are not liable for failed delivery resulting from an incorrect address provided by you.
For full delivery terms, please read our Shipping Policy at captaincyberchamp.com/shipping.
9. Returns and Refunds
Returns and refunds are governed by our Returns and Refunds Policy, which is incorporated into these Terms by reference. Key terms include:
• We offer a 30-day returns window from the date of delivery for eligible items.
• Print-on-demand items are non-returnable unless faulty, damaged, or incorrectly supplied.
• Digital products are non-refundable once downloaded or accessed.
• Items must be unused, unwashed, and in original condition to be eligible for return.
• Nothing in our Returns Policy limits your statutory consumer rights under applicable law.
For full returns terms, please read our Returns and Refunds Policy at captaincyberchamp.com/returns.
